OWI Attorneys What is the Legal Blood Alcohol Limit in Michigan?

In the state of Michigan, a person with a BAC of at least .08 percent can be arrested for DUI/OWI in Michigan. Blood alcohol concentration or content (BAC) is the amount of alcohol that is present in the bloodstream, according to the volume of alcohol consumed over a certain period.

Legal Alcohol Limit in Michigan

In addition, a commercial driver with a high BAC of at least .04 percent or an underage driver (under 21 years old) with a BAC of at least .02 percent can also be charged with drunk driving. Remember, having a high BAC of at least .17—more than twice the legal limit—can lead to harsher criminal penalties. In Michigan, a BAC of .17 is considered super drunk. A “Super DUI” is short for Michigan’s Super Drunk OWI Law, which imposes stiff penalties on those convicted of a DUI if their BAC is 0.17 or higher. What are the Factors Affecting High BAC?

There are several physiological factors that must be taken into consideration when figuring out how alcohol affects each person, which include the following:

  • How quickly you finish each drink (i.e., the faster you consume alcohol, the quicker your high BAC will increase)
  • The amount of food you’ve eaten before drinking
  • Weight (i.e., the more you weigh, the more water your body has to dilute the effect of alcohol)
  • Age (i.e., the older you are, the more pronounced the intoxicating effects of alcohol are)
  • Gender (i.e., women generally have a higher BAC if they consume the same amount of alcohol at a similar rate compared to men)
  • If any medication was taken prior to drinking
  • Other liquids used to mix alcohol (i.e., carbonated beverages increase alcohol absorption, while water and fruit juices slow it down)
  • Alcohol tolerance
  • Stress, fatigue, and mood

One unit of alcohol is equal to up to six ounces for a glass of wine, up to 12 fl. oz. for one bottle of beer, and up to 1.5 fl. oz. for 80-roof hard liquor.
